  • Legal & Safety: To comply with legal obligations, prevent fraud, and protect the safety of our users.

3. Data Sharing and Disclosure

We do not sell or rent your personal information to third parties. We may share your data with:

  • Service Providers: Subcontractors or software vendors (e.g., scheduling or billing platforms) who assist in our operations.

  • Equipment Manufacturers: If necessary for warranty registration or rebate processing.

TERMS & CONDITIONS

1. Right to Cancel

The Customer has the right to cancel this contract within 72 hours, unless otherwise specified in this agreement. Failure to cancel within 72 hours will result in forfeiture of any deposits.

If the contract is canceled after materials have been ordered or work has begun, the Customer is responsible for:

  • Any labor already performed

  • Restocking fees from supply houses

  • Equipment or materials that cannot be returned

All non-returnable materials will be charged to the Customer and paid to Cosmic Cooling LLC.

2. Acceptance of Proposal

By signing this agreement, the Customer acknowledges that all specifications and conditions are satisfactory and authorizes Cosmic Cooling LLC to proceed with the work described in this proposal.

  • Proposal pricing is valid for 30 days from the date issued.

  • Payment terms are as listed in the proposal.

  • Signature after work completion indicates the Customer confirms all work was completed to their satisfaction.

3. Installation of New Equipment

Cosmic Cooling LLC provides equipment recommendations based on industry experience and visible site conditions. Final responsibility for equipment sizing rests with the Customer.

Cosmic Cooling LLC is not responsible for:

  • Undersized electrical wiring or breakers unless electrical work is included in the contract

  • Existing ductwork conditions

  • Existing line sets

  • Existing insulation

  • Existing air handler stands

  • Existing drainage systems

Any repairs required for these items will be considered additional work and billed separately.

Cosmic Cooling LLC makes no guarantee regarding:

  • Specific humidity levels

  • Exact temperature levels within the home

  • Equipment runtime

  • Sound levels during operation

Customer is responsible for ensuring the home has adequate insulation and minimizing heat loads.

4. Ductwork Disclaimer

Cosmic Cooling LLC is not responsible for undersized, damaged, deteriorated, or improperly designed duct systems.

The Customer is responsible for having ductwork inspected if desired. Any duct repairs or modifications required will be quoted as additional work.

5. Gas Equipment Installations

When installing gas equipment, Cosmic Cooling LLC is responsible only for the connection from the equipment to the shut-off valve.

Cosmic Cooling LLC is not responsible for existing gas line leaks or defects outside of this connection point.

6. Service and Repairs

Cosmic Cooling LLC is not responsible for future equipment failures following repairs, diagnostics, or maintenance services.

No warranty is provided on repairs unless specifically stated in writing.

7. Customer Maintenance Responsibilities

The Customer is responsible for routine maintenance including:

  • Replacing air filters

  • Cleaning condensate drain lines

  • Maintaining proper airflow

Failure to perform maintenance may result in system failure, water damage, or service charges.

8. Permits

Permit fees are not included unless specifically listed in the proposal.

If permits are required:

  • The Customer agrees to pay all associated permit fees

  • The Customer must provide access for inspections

  • Any re-inspection or expired permit fees are the responsibility of the Customer

9. Refunds and Payments

Refunds or returns are not accepted once work has been performed or authorized.

If a refund is issued, the Customer is responsible for:

  • Processing fees

  • Credit card fees

  • Restocking charges

Returned checks are subject to a $75 fee.

10. Credit / Debit Card Policy

Payments made by credit or debit card for services rendered are not eligible for chargeback disputes once services have been completed under this agreement.

11. Manufacturer Parts Warranty

All equipment parts are subject to the manufacturer's warranty terms and conditions.

Cosmic Cooling LLC does not administer or guarantee manufacturer warranties.

Manufacturer warranties do not cover failures caused by:

  • Electrical surges

  • Lack of maintenance

  • Corrosion or rust

  • Animal damage

  • Physical damage or negligence

Miscellaneous installation components such as thermostats, wiring, float switches, and line insulation carry a 1 year limited parts warranty.

12. Limited Labor Warranty

Cosmic Cooling LLC provides a maximum 1 year labor warranty on new equipment installations unless otherwise specified in the contract.

Labor warranty coverage applies only to workmanship performed by Cosmic Cooling LLC.

Warranty coverage requires the Customer to maintain an active Cosmic Maintenance Plan (CMP) during the warranty period.

Failure to maintain an active CMP will void the labor warranty.

Extended labor warranties exceeding one year are provided by third-party providers or manufacturers, not Cosmic Cooling LLC.

13. Warranty Limitations

This warranty does not cover damage caused by:

  • Improper maintenance

  • Weather or environmental conditions

  • Electrical issues from utility power

  • Work performed by other contractors

  • Corrosion, flooding, fire, or lightning

Cosmic Cooling LLC’s total liability shall not exceed the amount paid for the work performed.

14. Drywall and Property Damage

Installation work may cause cracking or damage to drywall when accessing ductwork or equipment areas.

Cosmic Cooling LLC is not responsible for drywall repair or cosmetic repairs required after installation.

Customers must remove or protect valuable items from work areas.

15. Portable A/C Rental

If portable air conditioning units are provided:

  • Maximum rental period: 5 business days

  • Customer is responsible for any damage to the unit or property

  • Failure to return the unit may result in a $750 replacement fee

Deposits are refundable only if approved by Cosmic Cooling LLC.

16. Non-Payment

Failure to pay the balance due may result in:

  • Filing of a construction lien

  • Collection costs

  • Attorney fees

  • Interest charges
